Subject: 9681 /1991-174 HCA Parkridge Date: Mon, 27 Feb 1989 12:20:00 -0500 1991-174 HCA Parkridge ORDINANCE NO. 9681 AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF OAK STREET, VINE STREET, MCCONNELL LANE AND MCCONNEL STREET, AND ALLEYS LOCATED GENERALLY BETWEEN MCCALLIE AVENUE AND IVY STREET, AND BETWEEN LYERLY AND DERBY STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned portions of Oak Street, Vine Street, McConnell Lane, and McConnell Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Oak Street, a 50 foot wide right-of-way beginning on the southeast line of Lyerly Street 275 feet northeast of the intersection of the southeast line of Lyerly Street with the northeast line of McCallie Avenue, and extending southeast 100 feet between parallel lines. Said street separates part of lot 1, block 7, from part of lot 1, block 8, Henderson's Addition to Orchard Knob, as shown by plat of record in deed book X, volume 6, page 181, R.O.H.C. Vine Street, a 50 foot wide right-of-way beginning on the southeast line of Lyerly Street 280 feet southwest of the intersection of the southeast line of Lyerly Street with the southwest line of Ivy Street, and extending southeast 100 feet between parallel lines. Said street separates part of lot 1, block 6, from part of lot 6, block 7, Henderson's Addition to Orchard Knob, as shown by plat of record in deed book X, volume 6, page 181, R.O.H.C. McConnell Lane (formerly McConnell Alley), a 20 foot wide right-of-way beginning on the southwest line of Ivy Street some 89 feet northwest of the intersection of the southwest line of Ivy Street with the northwest line of McConnell Street, and extending southwest some 115 feet between parallel lines. Said street separates part of the Anna Elder Tract from part of the Headrick Tract. McConnell Street, a 20 foot wide right-of-way beginning on the southwest line of Ivy Street 465 feet northwest of the intersection of the southwest line of Ivy Street with the northwest line of Derby Street, and extending southwest some 115 feet between parallel lines. Said street separates part of the Anna Elder Tract from part of the McConnell Subdivision, not recorded. Any other named or unnamed streets and/or alleys that may be within the area bounded by McCallie Avenue on the southwest, Lyerly Street on the northwest, Ivy Street on the northeast, and Derby Street on the southeast, which have not been previously abandoned. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The reservation for the Tennessee-American Water Company of an easement in width of the right-of-way for the purpose of operating and maintaining their facilities located within the right-of-way of Oak Street, southeast at Lyerly Street. 2. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 3. The reservation of an easement the width of the right-of-way for Chattanooga Cable TV Company for the purpose of operating and maintaining its facilities in said right-of-way. 4. The areas reserved for utility easements must be kept free and clear of all structures. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
